TOKYO (AP) ? Camera and medical equipment maker Olympus is facing another legal battle over its treatment of a whistleblower employee a year after Japan's Supreme Court ruled it should reinstate the man in his regular job.

Masaharu Hamada has been assigned by Olympus to quality training, in which he has no experience. He sees the assignment as harassment.

He wants the Tokyo District Court to order Olympus to abide by the top court's ruling. Olympus says it complied with the Supreme Court decision.

Hamada was joined Monday by Yoshihisa Ishikawa who is suing Olympus for sending him to work under Hamada.

Hamada first sued Olympus in 2008 after being ostracized for relaying a supplier's complaint.

He is considered a whistleblower in Japan because he raised questions and was subjected to humiliating punishment.

(AP) ? More than three years after U.S. Army Pfc. Bradley Manning was arrested for giving classified secrets to WikiLeaks, a military judge acquitted the former intelligence analyst Tuesday of aiding the enemy but convicted him of espionage, theft and computer fraud charges.

The judge, Army Col. Denise Lind, deliberated for about 16 hours over three days before reaching her decision in a case that drew worldwide attention as supporters hailed Manning as a whistleblower. The U.S. government called him an anarchist computer hacker and attention-seeking traitor.

Manning stood and faced the judge as she read the decision. She didn't explain her verdict, but said she would release detailed written findings. She didn't say when she would do that.

The charge of aiding the enemy was the most serious of 21 counts Manning faced and carried a potential life sentence. His sentencing hearing on the convictions begins Wednesday. He faces up to 128 years in prison.

Manning's court-martial was unusual because he acknowledged giving the anti-secrecy website more than 700,000 battlefield reports and diplomatic cables, and video of a 2007 U.S. helicopter attack that killed civilians in Iraq, including a Reuters news photographer and his driver. In the footage, airmen laughed and called targets "dead bastards."

Manning pleaded guilty earlier this year to lesser offenses that could have brought him 20 years behind bars, yet the government continued to pursue the original, more serious charges.

Manning said during a pre-trial hearing in February he leaked the material to expose the U.S military's "bloodlust" and disregard for human life, and what he considered American diplomatic deceit. He said he chose information he believed would not the harm the United States and he wanted to start a debate on military and foreign policy. He did not testify at his court-martial.

Defense attorney David Coombs portrayed Manning as a "young, naive but good-intentioned" soldier who was in emotional turmoil, partly because he was a gay service member at a time when homosexuals were barred from serving openly in the U.S. military.

He said Manning could have sold the information or given it directly to the enemy, but he gave them to WikiLeaks in an attempt to "spark reform" and provoke debate. A counterintelligence witness valued the Iraq and Afghanistan war logs at about $5.7 million, based on what foreign intelligence services had paid in the past for similar information.

Coombs said Manning had no way of knowing whether al-Qaida would access the secret-spilling website and a 2008 counterintelligence report showed the government itself didn't know much about the site.

The defense attorney also mocked the testimony of a former supervisor who said Manning told her the American flag meant nothing to him and she suspected before they deployed to Iraq that Manning was a spy. Coombs noted she had not written up a report on Manning's alleged disloyalty, though had written ones on him taking too many smoke breaks and drinking too much coffee.

The government said Manning had sophisticated security training and broke signed agreements to protect the secrets. He even had to give a presentation on operational security during his training after he got in trouble for posting a YouTube video about what he was learning.

The lead prosecutor, Maj. Ashden Fein, said Manning knew the material would be seen by al-Qaida, a key point prosecutor needed to prove to get an aiding the enemy conviction. Even Osama bin Laden had some of the digital files at his compound when he was killed.

Some of Manning's supporters attended nearly every day of two-month trial, many of them protesting outside the Fort Meade gates each day before the court-martial. They wore T-shirts with the word "truth" on them, blogged, tweeted and raised money for Manning's defense. One supporter was banned from the trial because the judge said he made online threats.

Hours before the verdict, about two dozen demonstrators gathered outside the gates of the military post, proclaiming their admiration for Manning.

"He wasn't trying to aid the enemy. He was trying to give people the information they need so they can hold their government accountable," said Barbara Bridges, of Baltimore.

The court-martial unfolded as another low-level intelligence worker, Edward Snowden, revealed U.S. secrets about surveillance programs. Snowden, a civilian employee, told The Guardian his motives were similar to Manning's, but he said his leaks were more selective.

Manning's supporters believed a conviction for aiding the enemy would have a chilling effect on leakers who want to expose wrongdoing by giving information to websites and the media.

Before Snowden, Manning's case was the most high-profile espionage prosecution for the Obama administration, which has been criticized for its crackdown on leakers. The espionage cases brought since Obama took office are more than in all other presidencies combined.

The WikiLeaks case is by far the most voluminous release of classified material in U.S. history. Manning's supporters included Pentagon Papers leaker Daniel Ellsberg, who in the early 1970s spilled a secret Defense Department history of U.S. involvement in Vietnam.

The 7,000 pages of the Pentagon Papers showed that the U.S. government repeatedly misled the public about the Vietnam War.

The material WikiLeaks began publishing in 2010 documented complaints of abuses against Iraqi detainees, a U.S. tally of civilian deaths in Iraq, and America's weak support for the government of Tunisia ? a disclosure that Manning supporters said helped trigger the Middle Eastern pro-democracy uprisings known as the Arab Spring.

The Obama administration said the release threatened to expose valuable military and diplomatic sources and strained America's relations with other governments.

Prosecutors said during the trial Manning relied on WikiLeaks and its founder Julian Assange for guidance on what secrets to "harvest" for the organization, starting within weeks of his arrival in Iraq in late 2009.

Federal authorities are looking into whether Assange can be prosecuted. He has been holed up in the Ecuadorean Embassy in London to avoid extradition to Sweden on sex-crimes allegations.

Protection of Apollo Moon Landing Sites Sparks Controversy

A new bill introduced into the U.S. Congress would establish the Apollo Lunar Landing Sites National Historical Park on the moon. However, the proposal is seen by some as lightning rod legislation, sparking controversy in legal and public circles.

Called the Apollo Lunar Landing Legacy Act, the bill ? House Resolution (H.R. 2617 ? was introduced July 8 by Rep. Donna Edwards of (D-Md.) and was co-sponsored by Rep. Eddie Bernice Johnson (D-Texas).

In introducing the bill, Edwards said that the Apollo history, "as preserved on the lunar surface, is now in danger, as spacefaring commercial entities and foreign nations begin to achieve the technical capabilities necessary to land spacecraft on the surface of the moon." Edwards said her bill would expand and enhance the protection and preservation of the Apollo lunar artifacts while providing for greater recognition and public understanding of this achievement for generations to come.

Lunar artifacts

The Act, Edwards said, "will ensure that the scientific data and cultural significance of the Apollo artifacts remains unharmed by future lunar landings."

The Act would endow the artifacts as a National Historic Park, thereby asserting unquestioned ownership rights over the Apollo lunar landing artifacts. "The legislation will additionally require the Secretary of the Interior to pursue nominating the historic Apollo 11 lunar landing site, where humanity left its first steps on the moon, as a World Heritage Site," the lawmaker said.

Edwards said the Act builds on the recommendations of a 2011 report titled "NASA's Recommendations to Space-Faring Entities: How to Protect and Preserve the Historic and Scientific Value of U.S. Government Lunar Artifacts."

But the proposal has received a thumbs-down response from the Citizens Against Government Waste (CAGW) organization, based in Washington, D.C.

In a July 24 statement, the group gave Edwards and co-sponsor Johnson their "Porkers of the Month" honor "for straying so far from reality's orbit, wasting the taxpayers' money on the paper and ink on which H.R. 2617 is written, and engaging in sheer 'lunarcy.'"

Space archaeology

Not everyone disapproves, though.

"I applaud the idea that two Congresswomen have decided to spark public dialogue about protecting the artifacts on the moon as an important part of American and ultimately, humanity's lunar legacy," said Beth O'Leary, an associate professor of anthropology at the University of New Mexico in Las Cruces. She is a leading expert in the field of space archaeology.

"It will be interesting to see the responses to this effort by the federal agencies concerned," O'Leary told SPACE.com.?

One of the most important steps in doing anything for the first time, O'Leary said, "is to make sure that all those involved and concerned ? especially archaeologists, the historic preservation and the international community ? craft a plan together that will ultimately protect those unique artifacts and sites created by humans on another celestial body."? In reality, humanity went to moon on an extraordinary day now over 44 years ago, O'Leary said. "We have an opportunity now to honor that event and are entrusted to do so for the generations who will come after us."

Clumsy product

"In my view, the Bill is a rather clumsy product of a seemingly uninformed 'drafter' or drafting committee," said George Robinson, a space law practitioner and retired Associate General Counsel for the Smithsonian Institution.

"Referring to the proposed site as a 'national' park implies that only the United States and NASA should be recognized for the Apollo program and its successes and failures," Robinson told SPACE.com.

"In fact, many countries offered and provided critical components of the program, from alternate emergency landing sites, to unique technology and personnel with equally as unique specialty capabilities, to tracking stations, and on and on," Robinson said.

Element of ignorance

The proposed legislation seems "consistently inconsistent," Robinson said, and "reflects such an element of ignorance, superficiality, and casual disregard for current world opinion that it might well be tossed and a rewrite undertaken with some element of very relevant factual knowledge."

That recasting of the bill, Robinson emphasized, should include the fact that the "NASA of old no longer is capable of assuming independently the next step in leading the way to permanent off-planet migration and physical salvation of the humankind species."

"Perhaps, just perhaps, attention can be turned to the creation of a new and uniquely effective international, global, and perhaps even transglobal entity in which the United States could assume a very influential, if not lead role," Robinson added.

International forum

The reaction in the non-U.S. legal community has been one of concern and decided negativity, said Michael Listner, the founder and principal of the firm Space Law and Policy Solutions, based in New Hampshire.

"Preserving both the artifacts and the presence of mankind's historic activity on the moon is an important effort," Listner said, "but it will require a fresh legal strategy to obtain that goal preferably in the form of an international norm that allows a nation like the United States to exercise jurisdiction over landing sites, like Tranquility Base, for purposes of preservation without actually asserting sovereignty."?

Listner said that the approach taken by the bill is "fundamentally flawed" because it attempts to harmonize existing federal preservation law via the National Park system with "international law," which includes international space law.?

"The means of creating national parks under 16 U.S.C. 1 [Title 16 of the United States Code, which outlines the role of conservation in the code] requires sovereign control over the real property," Listner said. "Since the Outer Space Treaty prohibits sovereign claims over the moon, any attempt to create a National Park under 16 U.S.C. 1 will fail."

Investment of blood and treasure

The proposed idea of protecting lunar landing sites with national parks on the moonhas caught the ear of Homer Hickam, former NASA engineer and best-selling author of the memoir "Rocket Boys," later adapted into the popular film "October Sky." Hickham has foreseen that future moon residents would visit historic landing sites in his just released novel "Crescent," the second volume in a series called "Helium-3" (Thomas Nelson, May 28, 2013).

"To me, I'd claim those parts of the moon. We've certainly invested enough blood and treasure to do that," Hickam told SPACE.com. "To hell with any past agreements we've had ? they are pass?. That's sacred American soil as far as I'm concerned," he said, and advocates ringing the Apollo sites off and saying "all these worlds are yours, except these. Stay away from them."

Hickam said he's aware of plans by private commercial firms to send small rovers to the moon, able to trundle to Apollo landing sites.

"I'd like that, but I do think they have to be careful and not run over, say the Apollo 11 footprints, specifically. That would be like running over Columbus' footprint on the beach when he landed in the New World," Hickam said. "All of these things have to be protected."

Tourism will be a major industry on the moon, Hickam said. "So there will be another reason to preserve those sites," he said.

Golf cart crash leads to serious injury in Maine

CASCO, Maine ? Police in Maine say a golf cart accident caused injuries so serious that a LifeFlight helicopter was summoned.

The Cumberland County Sheriff's Department says 52-year-old John MacKay from Sanford was thrown from the golf cart that was being operated by a Massachusetts man Saturday night in the town of Casco.

There's been a steady drip of developments over the past year that have generally favored Samsung?most notably, US District Judge Lucy Koh's order that a retrial must be held on damages. That retrial could slash Apple's billion-dollar payday by up to $450 million.

Sunday night, Samsung lawyers filed an order just out from the US Patent and Trademark Office (USPTO) that renders invalid one of Apple's key patents, No.?7,844,915, the so-called "pinch to zoom" patent. It's definitely a setback for Apple, which presented "pinch to zoom" at last year's trial as one of the innovations that was ripped off by a wide array of Samsung phones.

This is the second Apple patent in its case against Samsung to be called into question at the Patent Office. Apple's "rubber banding" patent was tentatively overturned in October?but Apple eventually?prevailed in getting the key claims found patentable last month.

It will ultimately?be up to US District Judge Lucy Koh to decide how seriously to take this new development. Reexams are essentially a separate?and typically slower?path of resolving patent disputes. Patent holders can appeal these cases for years, both with the examiner and with the Board of Patent Appeals. The patent is still enforceable while the reexam process moves forward.

The damages retrial is scheduled for November. Apple also has design patents and trademarks that were found infringed in the case, so those aren't subject to reexams.??

Millions at Brazil Mass hear pope ask youth to change world

RIO DE JANEIRO (Reuters) - Rio's famed Copacabana beach, usually the venue for scantily-clad sun-seekers and revelry, became a massive Catholic campground on Sunday as Pope Francis concluded a youth festival by urging young people to go forth and build a new world.

A festive crowd estimated by organizers and the Vatican to be more than 3 million strong, including many who slept in the area and local residents who poured out of homes and buses, turned out to see the Argentine pope on the final day of his week-long trip.

Aerial television footage showed the sand and pavements blanketed with people for several kilometers along the crescent-shaped shoreline.

"I was totally tranquil, waking up among the people on the beach. This view made it a very special and unique experience," said Aline Vonsovicz, a 23-year-old Brazilian of Polish origin.

The throng of people, many in the green and yellow Brazilian colors, gave Francis the kind of ecstatic welcome that he has received all through his trip to his home continent.

They shouted and sang as he was driven through the crowd in an open-sided popemobile, stopping often to kiss babies offered to him by their mothers on the shoreline most famous for its bars and nightclubs and hedonist spirit.

His message to the young people in Rio for week-long World Youth Day festivities, sometimes called "the Church's Woodstock," was serious: they should not make their time in Rio a one-off experience.

In his sermon during the Mass from a huge white stage at the beach's northern tip, he said they should return to their home countries energized and ready to work for social change.

"Bringing the Gospel is bringing God's power to pluck up and break down evil and violence, to destroy and overthrow the barriers of selfishness, intolerance and hatred, so as to build a new world," he said.

LATIN AMERICAN PRESIDENTS AT MASS

Brazilian President Dilma Rousseff, Argentine President Cristina Fernandez, Bolivian President Evo Morales and several Latin American vice presidents were among those who attended.

The Copacabana events were to have taken place on a pasture on the outskirts of Rio, but days of unseasonable rain turned the area into a field of mud.

"It was cold in the morning and there was a problem with a long wait for the toilets. Some people went in the sea. It was a bit chaotic. But it was lovely," said Marcel Stelsberg, 27, who came from Copenhagen with a group 65 people from Scandinavia.

"People were playing guitars and drums and singing and dancing to religious songs different languages. Now we don't feel so alone, especially coming from Scandinavia where there are so few of us Catholics," he said.

Francis, who was due to leave for Rome on Sunday night after addressing Latin American bishops, has dedicated much attention in his speeches to the problems, the prospects and the power of youth. He announced that the next World Youth Day will be in Krakow, Poland, in 2016.

On Saturday night, he encouraged Brazil's young people, who have protested against corruption in their country, to continue their efforts to change society by fighting apathy and offering "a Christian response."

Brazil, Latin America's largest nation and still the world's most Catholic country despite declining numbers of faithful, was rocked by protests against corruption, the misuse of public money and the high cost of living.

On Friday night he urged them to change a world where food is discarded while millions go hungry, where racism and violence still affront human dignity, and where politics is more associated with corruption than service.

The day before, during a visit to a Rio slum, he urged them to not lose trust and to not allow their hopes to be extinguished. Many young people in Brazil saw this as his support for peaceful demonstrations to bring about change.

Starbucks Leading The Mobile Payment Parade: 10% of US Transactions Involve Smartphone

As far as rewards programs go, Starbucks has one of the least attractive on offer. Frequent hotel dwellers and airline goers have been pretty upset lately by point devaluations that are ruffling through the industry, but Starbucks gives loyal drinkers next to nothing for stopping in on a daily basis. Clearly, that's not hurting sales. The coffee giant still seems to be pulling customers in left and right, and while you'd think it would have to offer something fairly amazing to get people to pay using their phone, that evidently is not the case.

Mobile payments on the whole have struggled in the United States. Google Wallet has been all but a dud, and while Square is doing well, that still involves a physical credit card for most purchases. Starbucks, however, seems to be on its own planet. A new report suggests that 1 in 10 purchases made at Starbucks (U.S.) now involves a phone. That's right: 10% of all Starbucks transactions in the United States are completed with a phone.

Starbucks, to its credit, has been pushing mobile payments, and the Starbucks app makes it easy to pay using rechargeable Starbucks gift cards. But again, why are people doing it? The reward program is hardly awe-inspiring, so perhaps it's just easier? Or perhaps it's just the typical Starbucks crowd being more willing than most to give new technology a chance. Either way, it's interesting to see a cafe pushing mobile payments in a way that most other retailers could only dream of, even without heavy incentives to use it.
